Sales Terms and Conditions

6. The Contract Between Us

I must receive payment of the whole of the price for the goods/services that you order before your order can be accepted. Payment of the price for the goods/services represents an offer on your part to purchase the goods/services, which will be accepted by us only when the goods/services are confirmed. Only at this point is a legally binding contract created between us.

7. Acknowledgement of Your Order

To enable me to process your order, you will need to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.

8. Availability

All orders are subject to acceptance and availability. If the goods/services you have ordered are not available, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available or to cancel your order.

9. Price

The prices payable for goods/services that you order are as set out on my website unless you are ordering a bespoke service when the price will be quoted and confirmed by email.

Where it is not possible to accept your order to buy goods/services of the specification and description at the price indicated on our website, I will advise you by email, and offer to sell you the goods of the specification and description at the price stated in the email and will state in the email the period for which the offer or the price remains valid.

10. Payment Terms

I will invoice you for payment upon receipt of your order. I accept no liability if a delivery is delayed because you have not made the payment. If it is not possible to obtain full payment for the goods from you, then I can refuse to process your order and/or suspend any further orders to you. This does not affect any other rights I may have.

11. Cancellation Rights (Products)

Under the Consumer Protection (Distance Selling) Regulations 2000 you have the legal right to cancel your order up to seven working days after the day on which you receive your goods with the exception of any made to order items and digital items (e.g.: e-Books and online courses) where the item has been downloaded.

You do not need to give me any reason for cancelling your contract nor will you have to pay any penalty. However, you will need to notify me in writing or in any other durable medium if you wish to cancel your contract.

Once you have notified me that you are cancelling your contract, any payment made to me will be refunded as soon as possible by the same method as the original payment was made, and in any event within 30 days of cancellation.

12. Cancellation by Me (Products)

I reserve the right not to process your order if:

- One or more of the goods/services you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by me from our suppliers.

- If I do not process your order for the above reason, I will notify you by e-mail and will refund any sum received by me as soon as possible by the same method as the original payment was made, but in any event within 30 days.

13. Cancellation of Event and Workshop Bookings

If you cancel your place on one of my events or workshops, the proportion of the fee that will be refunded is as follows:

- More than 28 days before the event – 100%

- 14-27 days prior to the event – 50%

- 8-13 days prior to the event – 25%

- 7 days or less – 0%

On occasion unforeseen circumstances may make it necessary for Georgina Watson to cancel a seminar and accordingly I reserve the right to cancel seminars where appropriate. In such circumstances you will be given as much notice as possible and I will either refund the full seminar fee or, if you request, move the training to an alternative date. Liability for any losses other than the seminar costs will not be accepted.

Please note: If you cancel your place on one of my Lightning Process seminars, see the application form for the cancellation details as they are specific to that training and override the above.

14. Liability

14.1     I am only responsible for losses that are a natural, foreseeable consequence of my breach of these Terms and Conditions.  I do not accept liability if I am prevented or delayed from complying with my obligations set out in these Terms and Conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond my reasonable control.

14.2     Furthermore, I do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

Neither Georgina Watson nor any party involved in creating, producing, or delivering the website, or any of the material or information contained in the website is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the website. While Georgina Watson uses reasonable efforts to include accurate and up-to-date information on the site, Georgina Watson also assumes no responsibility for and shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the website or your downloading of any materials, data, text, images, video, or audio from the website.

Georgina Watson will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and me when you commenced using the website or when a contract for the sale of goods by me to you was formed. Georgina Watson does not limit in any way my liability by law for death or personal injury caused from my negligence or breach of duty.

18. Alteration of Service or Amendments to the Conditions

I reserve the right to make changes to my website, policies, and these Terms and Conditions of Use and Sale at any time by updating this posting. You will be subject to the policies and Conditions of Conditions of Use and Sale in force at the time that you use the website or that you order goods from me, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition. You should periodically visit this page to review the current Terms and Conditions to which you are bound.

19. Events Beyond Our Reasonable Control

I will not be held responsible for any delay or failure to comply with my obligations under these conditions if the delay or failure arises from any cause which is beyond my reasonable control. This condition does not affect your statutory rights.
